Kevin Fine, a judge in the Texas county that sends the most inmates to death row, has just ruled that the death penalty is unconstitutional:
Saying he could assume that innocent people have been executed, state District Judge Kevin Fine ruled in a pre-trial motion in a capital murder case on Thursday that the death penalty was unconstitutional and found himself on Friday facing a torrent of criticism from a string of high-profile Texans including Gov. Rick Perry.
The defense in the murder case argued that the death penalty violated the defendant's constitutional right to "due process" because it could be misapplied, and result in the execution of an innocent person.
